Another major controversy is unfolding at the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the Department of Justice. While this agency is not new to controversy this one goes way beyond policy debates. It unfortunately, cuts straight to privacy, trust, and government accountability. Gun Owners of America (GOA) is calling for an immediate investigation after a serious and unlawful disclosure of sensitive gun owner data.
What Happened
During ongoing litigation in Silencer Shop Foundation v. ATF, DOJ attorneys reportedly filed documents on a public court docket. This document included highly sensitive personal information belonging to a GOA member.
According to GOA, the disclosures included two approved ATF Form 1 documents (legally protected tax records). It also included the individual’s name, city, and state. As with all Form 1 documents it also contained detailed information about the number of NFA-regulated items owned.
What is even more concerning is after being alerted to the issue, the government allegedly re-filed documents containing similar sensitive information again. This shows a blatant lack of awareness towards personal privacy and sensitivity for citizens.
Why This Matters
Under federal law (26 U.S.C. § 6103) tax return information is strictly confidential. This does include National Firearms Act (NFA) registration forms. This is because all NFA forms are, in fact, tax documents on serialized items within the NFA.
GOA argues that by placing this information on a public docket, federal agencies violated federal privacy laws. This was done by exposing a private citizen’s firearm ownership details. It does create a potential safety risk for that individual as all his personal information, and what he owns is now out in the public sphere.
GOA Calls for Accountability
GOA Senior Vice President Erich Pratt has formally requested that the DOJ’s Office of Inspector General launch an investigation. The hope is to determine whether laws or internal policies were violated and who authorized or allowed the disclosure.
This is critical so we can identify what safeguards failed and how similar incidents will be prevented moving forward. The request also seeks clarity on whether ATF warned DOJ about the sensitivity of the information before it was made public.
The Bigger Concern: “Doxxing” Gun Owners
At 2 If By Sea Tactical, we’ve covered ongoing concerns about federal data collection and firearm records. There are reasons why we take extra steps here in our store to ensure your personal information is not leaked to the public nor given to the government.
This incident raises serious questions about how government handles such sensitive information. One must ask ff the government can expose protected firearm-related tax data once—what prevents it from happening again?
Publishing details about someone’s firearm ownership could make them a target for theft. It opens the door to exposing them to harassment. This is a major compromise to personal security. Let’s be clear, this isn’t just a paperwork error, it’s a potential breach of trust with real-world consequences.
Not Just a Gun Issue
While this case involves firearm ownership, this is an issue well beyond the world of firearms. This is about privacy rights and Government transparency. We must hold our government accountable when mistakes—or misconduct—occur.
Because if federal agencies mishandle protected data in one area, it raises concerns about how they handle it across the board. This is not something isolated to just a single agency. We have seen incidents like this happen all over the country and across the world. Canada recently had a data breach as did California.
GOA is pushing for a full investigation and demanding answers. We need to identifying responsible officials. This should result in an automatic review of DOJ and ATF procedures. Once we understand how this happened, we must demand implementation of safeguards to protect gun owners’ information.
Whether that investigation happens—and what it uncovers—will be critical. At this point, nothing has been confirmed by either the ATF or DOJ that they are looking into this. Accountability from our government is a cornerstone of this republic.
Bottom Line
This situation isn’t about politics, it’s about trust. We must ask if the government be trusted with sensitive firearm ownership data? The obvious answer is no of course. However, since they do have it under our current system, what can we do to protect that data? Will agencies be held accountable when that trust is broken?
We here at 2 If By Sea Tactical see this as part of a broader issue. We understand that government is on a path of ever-expanding control over firearms. This often comes with expanding control over information. When that information isn’t protected, the risks go far beyond the courtroom.
