Virginia Pushes One of the Nation’s Harshest Gun Bans — Legal Challenges Expected

Virginia lawmakers have moved forward with what many in the firearms community are calling one of the most sweeping gun control packages in the country. With the legislation now headed to the governor’s desk, Second Amendment advocates across the nation are preparing for a major legal battle.


The Virginia General Assembly recently passed several anti-gun measures, including a broad ban on commonly owned semi-automatic firearms, restrictions on standard-capacity magazines, new limits on carrying firearms on public property, and regulations targeting businesses within the firearms industry.

For gun owners and constitutional advocates, the most concerning measure is Virginia Senate Bill 749, which would criminalize the import, sale, manufacture, purchase, and transfer of many semi-automatic rifles and magazines capable of holding more than 15 rounds. If signed into law, which it almost certainly will, the legislation would take effect on July 1, 2026.


Firearms Community Pushes Back

Second Amendment organizations have already begun mobilizing in response. Brandon Combs, Founder & President of Firearms Policy Coalition, issued a sharp rebuke of the legislation, warning that legal challenges are already being prepared.


“Instead of upholding the rights of Virginians, tyrants in Richmond have voted to gut the Constitution and turn peaceable gun owners into felons. FPC has been preparing a federal lawsuit to challenge this immoral ban on constitutionally protected firearms and magazines. We will not hesitate to sue to defend Virginians against their authoritarian government if Governor Abigail Spanberger signs this anti-gun bill into law.”

Other national organizations have echoed similar warnings. The National Rifle Association Institute for Legislative Action has urged Virginians to contact the governor and demand a veto of the legislation, describing the measures as extreme infringements on constitutional rights. Meanwhile, Gun Owners of America has warned that the bills will almost certainly trigger lengthy and expensive litigation if enacted.


“Make no mistake, this bill will trigger lawsuits resulting in years of expensive litigation for Virginia taxpayers,” the organization stated. “The Commonwealth will be forced to fund the legal defense of obviously infringing legislation.”

A Symbolic Moment for a Historic State


The timing of the legislation has also drawn criticism because of the state’s historic connection to the founding of the United States. Virginia is the birthplace of several key figures in the American Revolution and the drafting of the Constitution, including George Washington, Thomas Jefferson, and James Madison.

The new restrictions are scheduled to take effect in 2026—just weeks before the nation celebrates the 250th anniversary of American independence. The very independence that was gained through private firearm ownership. Not to mention the irony of sweeping gun restrictions in a state whose official motto is “Sic Semper Tyrannis,” Latin for “Thus Always to Tyrants.”


What Happens Next


If Governor Abigail Spanberger signs the legislation—as many observers expect—legal challenges will likely begin almost immediately. Second Amendment groups argue that banning commonly owned firearms and magazines directly conflicts with Supreme Court precedent recognizing that arms in “common use” are protected under the Constitution. As these lawsuits move forward, they may ultimately help determine how courts across the country interpret firearm bans.


Why It Matters Beyond Virginia


For gun owners nationwide, the developments in Virginia are about more than just one state. Similar legislation has been introduced in states like Minnesota and others across the country. The outcome of the legal battles in Virginia could play a major role in shaping future Second Amendment cases—and may ultimately force the U.S. Supreme Court to address the constitutionality of bans on commonly owned firearms.
