Minneapolis Moves to Pass Gun Ban — Despite State Law Saying They Can’t

The Minneapolis, MN City Council is pushing through a gun control bill in violation of state law.

Minnesota lawmakers aren’t the only ones pushing gun control. We have seen Saint Paul the city push it’s own gun control bills in violation of state law. Now we have the city of Minneapolis joining the fray.


The Minneapolis City Council is preparing to pass a sweeping new gun control ordinances. They are attempting to pass a ban on so-called “assault weapons”, a ban on standard-capacity magazines, restrictions on so-called “ghost guns”, and expanded gun-free zones in public places.


This is all despite the fact they themselves acknowledge that they do not have the authority to do this. State Preemption Laws, prevent cities from superseding the state on certain matters and that includes firearm laws. This is done to ensure all Minnesotans can understand what is legal and what is not.


Why They’re Doing It


City officials are out in the open about their intentions. They are not even attempting to do this for just local policy but to in their words “put pressure” on the state legislature. Council members have openly stated they want to push broader gun control at the state level.


They view these ordnances as a means in which to force action through political pressure. However, violating the law by those elected to represent us should never be used as a political tool. This is as much political strategy as it is policy.


Unanimous Support


All 13 city council members are backing the ordinance. Of course, Mayor Jacob Frey (D) is also on board. This means this is most likely to pass. But this is where things get tough for the council. Minnesota Gun Owners Caucus is already preparing to challenge it.


It is not like they do not understand this will happen. When St. Paul passed a similar ordinance it was immediately hit with a lawsuit. While that case is still ongoing it is a colossal waist of taxpayer money passing laws that are illegal. There should be consequences for those that pass these laws.


These types of ordinances are dangerous and illegal. Cities cannot just ignore state law whenever they want to. There are proper channels elected officials must go through to govern and when those are violated, there must be consequences.


This city ordinance comes right on the heels of gun control moving through the state capitol. This shows a coordinated effort by anti-gun politicians and groups to restrict people’s legal constitutional rights. This is what we must fight on all fronts.


If the ordinance passes, we know lawsuit will immediately follow. The most likely outcome is that a court blocks the ordinance, and this ends up in a long legal battle. It will cost taxpayers millions to defend an illegal ordinance.


Minneapolis will continue moving forward with gun control measures, even though state law says they can’t. We will be watching this fight closely as this could signal a trend for other anti-gun cities to follow.
