Tennessee HB 1971: A Dangerous Move to Shield Unconstitutional Laws from Review

Lawmakers in Tennessee are advancing HB 1971, a bill that could dramatically limit citizens’ ability to challenge unconstitutional state laws—including unconstitutional gun laws. At first glance, the legislation may sound procedural. In reality, it strikes at a foundational constitutional principle: access to the courts.
What HB 1971 Would Do
Under current Tennessee law, individuals and organizations have a clear legal pathway to challenge state statutes in court if they believe those laws violate the Constitution. This allows unconstitutional laws to be reviewed and potentially struck down before someone is arrested, fined, or prosecuted.
HB 1971 would eliminate that pathway. As written, the bill would:
Allow constitutional challenges against local governments,
But exclude challenges to laws passed by the Tennessee Legislature itself.
In practical terms, this means state-level laws—even if unconstitutional—could remain on the books without a clear mechanism for pre-enforcement judicial review.
Why This Is Especially Concerning for the Second Amendment

Many firearm regulations do not immediately result in arrest or prosecution. Instead, they more often restrict lawful conduct, create regulatory burdens, chill constitutionally protected activity, and leave citizens uncertain about compliance. If HB 1971 becomes law, unconstitutional gun laws could effectively avoid meaningful judicial scrutiny—not because they are constitutional, but because access to the courts has been restricted.
Courts are meant to serve as a check on government power. Shielding laws from review undermines that safeguard. This is what government is supposed to do under our founding principles. Guard the rights of it’s citizens.
A Broader Constitutional Issue
At 2 If By Sea Tactical, we believe this issue goes beyond Tennessee and beyond firearms. This can impact us here in Minnesota and give us a template to advocate for in our own state. While we will face stiff odds and even stiffer pushback, it is still a fight worth having. We defend the Second Amendment—but we also stand for the broader constitutional structure that protects all Americans.
When legislature attempts to narrow access to judicial review, it sets a troubling precedent as today it may affect gun laws, but tomorrow it could affect speech, property rights, or due process. The Constitution only functions when citizens can challenge laws they believe violate it.
