
The 9th Circuit Once Again Toys With Gun Owners

Some things in in firearm law are constant. One of those being the 9th Circuit Court of Appeals that govern the western coast of the United States attacking law abiding gun owners’ individual rights. The case, Rhode v. Bonta, has been percolating through the court system since 2018. This lawsuit is in response to a state law that requires mandatory background checks on ammo sales. As if that was not far enough, it also bans direct shipping of ammo to your house and bringing in ammo legally acquired from another state.
It is one of the most stringent infringements in the nation further eroding gun rights in the Golden State. The law was fraught with problems including errors in the background check system resulting in nearly half of the sales denied by system error. Enter national ranked shooter and Olympic Gold Medalist shooter Kim Rhode who sued the state of California over this restriction.
As this law worked its way through the court system in California it was struck down by a Three Judge Panel in the 9th Circuit just a few weeks ago. This has resulted in the 9th circuit taking it up En Banc to be heard in front of the entirety of the 9th Circuit.
En Banc reviews of cases are normally quite rare. However, when it comes to gun rights it has become a term far too frequently used against law abiding gun owners. The decision to take this case up En Banc, more than likely will mean that the 9th Circuit will overturn the ruling against California and reinstate the law.
This is a twist that has frequently come to pass in the 9th Circuit. It is also why the 9th Circuit holds the record for being the Circuit overturned the most by the Supreme Court. This case Rhode v. Bonta more than likely will have to get appealed up to that level to get a final resolution.

Far to often, the Supreme Court has passed on 2nd Amendment cases and have allowed Circuit Courts like the 9th Circuit erode the rights that are enshrined in our constitution.
