The Second Amendment Should Apply Everywhere the American Flag Flies - Including Peurto Rico

The right to keep and bear arms does not stop at the shoreline. That principle is at the center of an important fight currently unfolding in Puerto Rico, where lawmakers are considering legislation that could restore meaningful Second Amendment protections for millions of Americans living on — or traveling to — the island.
Two bills, PC 1138 and PC 950, are currently moving through the Puerto Rico legislature. If passed, they would take significant steps toward expanding firearm rights and improving self-defense protections for law-abiding citizens. At 2 If By Sea Tactical, we believe the Constitution should apply equally everywhere the American flag flies — including U.S. territories like Puerto Rico.
PC 1138: Expanding Carry Rights
The first bill, PC 1138, would bring Puerto Rico closer to recognizing the right to carry firearms for lawful self-defense.
Among other provisions, the bill would:
Establish reciprocity so Americans with concealed carry permits from their home states could legally carry while visiting Puerto Rico
Clarify that individuals may lawfully carry more than one handgun
Require firearms seized during criminal investigations to be returned promptly once cases are resolved
Eliminate redundant inspections of firearm dealers that are already conducted by federal authorities
Perhaps most importantly, the bill would allow Americans visiting the island to exercise their right to self-defense rather than being forced to leave that right behind when traveling. For many gun owners on the mainland, current law effectively disarms them the moment they arrive in Puerto Rico. PC 1138 would begin to change that.
PC 950: Protecting Victims of Domestic Violence

The second bill, PC 950, focuses on strengthening protections for victims of domestic violence. Currently, victims seeking protection may only receive a temporary firearm permit that lasts 90 days.
PC 950 would instead provide victims with an immediate five-year carry permit at no cost, ensuring they are not left defenseless while navigating legal processes or waiting for bureaucratic approvals. Supporters of the bill argue that when someone faces a credible threat, delays can be dangerous — and immediate access to self-defense tools can save lives.
Why This Issue Matters
Right now, law-abiding Americans who travel to Puerto Rico are generally unable to legally carry firearms, even if they possess valid carry permits in their home states. For many, that means surrendering their ability to defend themselves simply because they crossed into a U.S. territory.
That situation raises serious questions about whether constitutional protections are being applied consistently across the United States and its territories. If the Second Amendment protects Americans on the mainland, many believe those protections should extend to citizens living under the same flag in Puerto Rico.
A Step Toward Broader Reform
Some advocates believe Puerto Rico should ultimately adopt constitutional carry, similar to the growing number of U.S. states that allow law-abiding citizens to carry firearms without a permit. However, legislation often moves forward one step at a time. Bills like PC 1138 and PC 950 represent meaningful progress toward recognizing the right of self-defense for citizens and visitors alike.
The Bigger Picture
The debate in Puerto Rico highlights a larger national question: Do constitutional rights apply equally across all U.S. jurisdictions? For many Second Amendment supporters, the answer is simple: the Constitution should not change depending on geography. Whether someone lives in a state or a territory, their fundamental rights should remain the same.
