Virginia Gun Ban Just Got Worse: Governor Expands “Assault Weapons” Bill

Just when it looked like Virginia’s sweeping gun ban couldn’t get any worse—it did. Governor Abigail Spanberger has officially sent SB 749 / HB 217 back to the legislature with amendments, and early details suggest the new version is even more aggressive than the original bill.
From Bad to Worse
Originally, the legislation aimed to ban the sale, transfer, and manufacture of commonly owned semi-automatic firearms and magazines over 15 rounds. Now? The governor’s substitute appears to expand the definition of “assault firearm” even further and tighten restrictions beyond what lawmakers initially passed.
According to lawmakers reviewing the changes, this isn’t a compromise—it’s an escalation. Governor Spanberger was backed by every major gun control group in the country. The entire Virginia election in 2025 was backed by these groups. The results are some of the most aggressive anti-gun measures we have ever seen.
What the New Version Targets
Under the amended language, the bill reportedly expands the ban to include any Semi-auto rifles with detachable magazines. Before it was just those “fixed” with a datable magazine. Add that in with the list of “undesirable” features like; Pistol grips; Folding or adjustable stocks; Flash suppressors; Threaded barrels / suppressor-ready designs; Forward grips.
This list makes most if not all semi-auto firearms subjected to and banned under the legislation. This law does not stop at just rifles. It also applies to semi-auto pistols with multiple listed features, semi-auto shotguns, and belt-fed firearms. Translation, a massive portion of modern firearms in common use.
Magazine Ban Tightened
The original bill capped magazines at 20 rounds. However, this updated version drops that limit to 15 rounds. That means even more standard, commonly owned magazines would fall under the ban. This is a sweeping attack on Virginians Second Amendment rights.
New Penalties for Law-Abiding Gun Owners
It doesn’t stop at banning future sales. The amended bill reportedly includes criminal penalties for violations and a 3-year firearm prohibition for anyone convicted. So not only are Virginians being restricted— they’re being turned into prohibited persons from just exercising their rights. This is the goal, to legislate away civilian firearm ownership.
A Political Move Disguised as “Clarity”
The governor’s office claims the changes are meant to “clarify” enforcement and protect certain hunting firearms. But it is obvious to anyone paying attention—to see what’s really happening. This “amendment” is designed to expand the scope while trying to make it more defensible politically.
What Happens Next
Virginia lawmakers return to Richmond on April 22, where they will vote to accept or reject the amendments. They need only a simple majority to move forward. If approved, the ban takes effect July 1, 2026. It would be shocking if these bills are not approved at this point given the make up of the legislature in Virginia.

The reality is this is a nationwide strategy, not a one-off bill. We are increasingly see national politics infect states and the Bill of Rights. Increasingly, we are seeing bills in California end up in New York and elsewhere. Anti-2A politicians are mobilized, in a response to Bruen, to curtail freedoms.
Make No Mistake
The obvious must be said here, this has nothing to do with safety. It’s about using the guise of “safety” to normalize banning common firearms. By nature this will expand government control over lawful ownership and turn everyday gun owners into criminals. Ultimately, this would allow governments to remove firearms completely from civilian ownership similar to what we see in the U.K. and Australia.
Once this happens, freedom ceases to exist. Free speech and other tenants of our Bill of Rights will be chipped away at. Eventually, we will find ourselves at a point where the Bill of Rights are not even worth the paper they are printed on if we do not fight to keep it. Virginia is a testing ground for those who want to restrict. The time to fight back is now.

Legal challenges are already being prepared, and this fight is far from over. But one thing is clear the line is being drawn right now. Gun owners across the country should be paying very close attention and uniting behind a unified front to maintain our birthright.
