DOJ Files Lawsuit Challenging Washington, D.C. Assault Weapons Law

Monday December 22nd, 2025 had a monumental shift in US domestic policy.  The Department of Justice under Pam Bondi sued the District of Columbia over its “Assault Weapons” Ban.  This is the first time that the Federal Government has stated, in a lawsuit it initiated, that bans such as these are unconstitutional.  This comes on the heals of a lawsuit against the U.S. Virgin Islands over its infringement on the 2nd Amendment.

               

This is another lawsuit by the Assistant Attorney General Harmeet Dhillon’s 2nd Amendment Civil Rights Division.  They are moving fast at attacking state, territorial, and now district gun control laws.  This is an extremely positive move as we have been wondering what kind of teeth this division would have and we appear to now have our answer.

Attorney General Bondi made a very pointed statement saying, ""Washington, D.C.’s ban on some of America’s most popular firearms is an unconstitutional infringement on the Second Amendment — living in our nation’s capital should not preclude law-abiding citizens from exercising their fundamental constitutional right to keep and bear arms".

               

This does bring into focus the strategy of the newly formed division.  They are aggressively going after lower-level gun control laws.  This is a welcome break to have the Federal Government fight on behalf of its citizens.  Unfortunately, this is all to rare in American society.  There has been one glaring issue with the Trump Administrations approach to the 2nd Amendment in their second term, and that is Federal Gun Control laws.  They have continued to posit that those laws are constitutional.


                While there is a Constitutional argument for this as the Bill of Rights is written directly to the Federal Government, this is still a flawed approach and has angered gun owners.  There is no reason they cannot attack both Federal and lower-level gun control laws at the same time.  One does not need to pick and choose.  We will continue to hope this new division will continue to be aggressive and start attacking Federal level laws as well.


The big question is are these lawsuits out of the Trump Administration a course correction for this Administration?  Or are they just trying to throw some bones to gun owners ahead of the 2026 Mid-Term elections.  As gun owners now is the time to keep the pressure on and restore our God Given rights.  These moves, however, regardless of how they are done, are a positive move for an administration that has been lukewarm on the 2nd Amendment.
