“Reasonable Controls” The New Backdoor Strategy to Regulate the Gun Industry

Across the country, anti-gun activists believe they’ve found a new way to sidestep the Second Amendment, democratic accountability, and federal protections for the firearms industry. The strategy? So-called “firearm industry responsibility” laws.


At 2 If By Sea Tactical, Southern Minnesota’s premier indoor range and firearms store, we believe gun owners need to understand exactly what these laws are — and why they matter.


What Are “Reasonable Controls” Laws?


In roughly ten states so far, lawmakers have enacted statutes requiring members of the firearms industry to implement undefined “reasonable controls” over the sale, manufacture, distribution, and marketing of firearms and related products. The problem? The term “reasonable controls” is vague, open-ended, and undefined.

That means:


  • Dealers cannot clearly know how to comply.

  • State officials can reinterpret requirements at will.

  • New restrictions can be imposed through lawsuits — not legislation.


These laws don’t just affect manufacturers and FFL dealers as defined under federal law. They extend to anyone involved in the stream of commerce for firearms, ammunition, magazines, components, and accessories. In short, the entire industry.


The Goal: Regulation Through Ruinous Liability

The strategy is simple: Use the threat of devastating civil lawsuits to force the firearms industry to adopt gun controls that lawmakers either couldn’t pass — or that would be unconstitutional if imposed directly.


Rather than passing new laws through elected legislatures, activist attorneys general attempt to:


  1. File civil enforcement actions

  2. Ask courts to “interpret” vague language broadly

  3. Secure injunctions that impose new compliance mandates


It is regulation by lawsuit. It is precisely what Congress sought to prevent when it passed the Protection of Lawful Commerce in Arms Act (PLCAA).

Consider what happened in New Jersey. In 2022, the state enacted a “reasonable controls” statute requiring gun industry members to adopt unspecified safeguards beyond existing statutory requirements. In July 2025, a New Jersey court sided with Attorney General Matthew Platkin in an enforcement action against Butch’s Gun World.


The state did not allege that specific ammunition sales violated existing “handgun ammunition” statutes. Instead, it argued that the store had an affirmative duty under the vague “reasonable controls” language to apply handgun-ammunition safeguards to all gun-related products — even though the legislature never explicitly required that. The result?


The court imposed sweeping requirements on the dealer, including:


  • Restricting sales of all gun-related products to permit holders or licensed dealers

  • Requiring additional ID verification

  • Mandating detailed recordkeeping and reporting

  • Imposing internal policy drafting and staff training requirements


In effect, the Attorney General expanded firearms regulations through litigation — not legislation.


Why the PLCAA Exists


The Protection of Lawful Commerce in Arms Act was enacted in 2005 specifically to stop this kind of strategy. Congress recognized that anti-gun activists were attempting to bankrupt the firearms industry through coordinated lawsuits seeking:


  • Design mandates

  • Distribution restrictions

  • Marketing controls

  • Rationing schemes

As Senator Tom Coburn explained at the time, activists were trying to achieve through courts what they could not achieve through legislation. Even the U.S. Supreme Court recently reaffirmed the importance of the PLCAA in Smith & Wesson Brands v. Estados Unidos Mexicanos (2025), recognizing that Congress intended to prevent exactly this type of litigation-driven gun control.


Why This Should Concern Minnesotans


We are already seeing aggressive gun legislation proposed in Minnesota — including HF 3433 and HF 3402. If “reasonable controls” statutes spread further, they could:


  • Target local FFLs

  • Impose compliance burdens far beyond written statutes

  • Drive small businesses out of operation

  • Restrict lawful access for everyday citizens


This is not just about manufacturers in distant states. It affects your local gun shop. It affects your range. It affects your ability to lawfully purchase firearms and accessories.


Regulation Without Representation

The deeper issue here is constitutional structure. The Second Amendment protects the right to keep and bear arms. The PLCAA protects the lawful firearms industry from being destroyed by politically motivated lawsuits.


Democratic accountability requires that major policy decisions be made by elected lawmakers — not imposed incrementally through civil liability theories. When vague language like “reasonable controls” becomes a blank check for regulators, constitutional rights are put at risk.


What Can Be Done?


Federal courts should make clear that these statutes conflict with the PLCAA’s purpose. However, gun owners cannot rely solely on litigation. We must:


  • Stay informed

  • Support pro-Second Amendment advocacy groups

  • Oppose vague liability schemes at the state level

  • Engage lawmakers before these bills gain traction


We will always support responsible firearm ownership, support lawful commerce, fight constitutional protections, and demand transparency in regulation. Gun control by civil liability is not democratic reform — it is strategic circumvention. The Second Amendment is not a second-class right.
