They Don’t Need a Warrant—They Just Buy Your Data

The U.S. government is increasingly buying citizens data from information brokers on the public market to spy on Americans.

You can forget kicking in doors to get information. Today, the government can learn a lot about you without ever leaving a desk—and without ever asking a judge. All it takes is a credit card.


The Rise of Government Data Buying


Federal agencies are now purchasing massive amounts of data from private brokers. We are talking about personal data such as location history, browsing habits, and online activity. With this data, the government can compile your interests, hobbies, and behavior patterns.


The reality is anything collected by tech companies and sold on the open market can be bought by the government. This is something we are increasingly seeing agencies within the U.S. doing. It is a massive privacy issue.


While this data is open on the market, we should be serious about restricting what the government can purchase and compile. The dangers here are enormous. This is how “social credit” can take root inside a country.


“Social Credit” is where a society takes your entire online essence and categorizes you into silos based on what the government deems “favorable” or “disfavorable” behaviors. This is the very thing we see foretold about in George Orwell’s book 1984.


The Loophole


The constitution does have built in protection against this in the Bill of Rights. The Fourth Amendment says the government can’t seize your private information without a warrant. However, we are seeing the government work around this restriction by interpreting if a private company already collected your data, the government could just purchase it.


They can do this without a warrant. Since there is no warrant, they do not need probable cause or court oversight to do so. This is highly concerning and flies in the face of what the Fourth Amendment was supposed to stand for. We here at 2 If By Sea Tactical see this for exactly what it is, a massive loophole in violation of the constitution.


Why Gun Owners Should Pay Attention


This does not happen in a vacuum. We see us gun owners increasingly being swept up in broader surveillance techniques. Under the Biden Administration this was often used against lawful gun owners that had purchased items legal at the time. We are increasingly seeing federal agencies expanding domestic monitoring authorities.


When it comes to gun owners specifically, we are often subject to political labeling to certain categories by the government based on firearm ownership. This comes with increased interest in tracking behavior, associations, and patterns of gun owners.


The scary part is if you combine that with detailed personal data + advanced analytics, the government can start targeting us on a much broader picture.


Enter FISA Section 702


Then there’s FISA Section 702. Originally intended to track foreign threats, it allows intelligence agencies to collect communications involving foreign targets. There is a catch, however, if an American communicates with that target, their data can be collected too with no warrant required.


This is what led to the Edward Snowden scandal. Mr. Snowden, exposed how vast the spying on Americans were inside our federal government. He stated several times that queries on Americans are often asked for 2x more often than foreign adversaries.


The Role of AI


With the emergence of AI into the mix, we can expect this to only get worse. With AI-driven tools, agencies can analyze massive datasets instantly and cross-reference behavior patterns. With all this data they can build detailed profiles on individuals all without ever getting a warrant to do so.


We now see what  used to take months of investigation happening in seconds. The profiles get even more detailed when you combine both purchased data and surveillance authorities with AI processing. This is a system capable of tracking people at scale never before seen.


The Bigger Concern


This is a huge warning about an issue that is happening now and more importantly, what comes next. With this existing infrastructure, it can all be used by any future administration, regardless of politics, against those deemed “undesirable”. We as legal and lawful gun owners, often find ourselves in this category by the government.


Efforts to Close the Loophole


We are seeing some attempts to address this loophole. With pieces of legislation like Fourth Amendment Is Not For Sale Act and Security and Freedom Enhancement Act, we are seeing attempts to require warrants for purchased data. Most importantly, these pieces of legislation are aimed at closing the commercial data loophole.


We see groups like Gun Owners of America are pushing hard for these reforms. Supporting these bills would go a long way into restoring the constitutional protections that are a part of our Bill of Rights.


While reporting on this issue often gets us labeled as “conspiracy theorists” this isn’t about speculation—it’s about capability. We understand that the  tools are there for the government to exploit. We also understand that since the data is available and loopholes exist, government will always attempt to exploit it.


Once a government starts down this path, it never shrinks its capability, it only expands it. We see this as a critical issue for anyone who values privacy and constitutional rights. Because when the government can buy what it can’t legally take, the line between security and surveillance starts to disappear.
